1. SCOPE

These general terms and conditions apply to all orders that you, as our customer, place via the meinekatikaturen.ch online shop, or to offers that Herz-Gift.ch submits.

2. OFFER AND CONCLUSION OF CONTRACT

2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order.

2.2 By clicking the (Order) button, the customer places a binding order for the products listed on the order page. After the order has been sent, the customer can no longer make any changes to the order.

2.3 Immediately after receipt of the order, Herz-Gift.ch confirms receipt of the order by e-mail. The purchase contract is only concluded when Herz-Gift.ch confirms the dispatch of the goods by e-mail (order or dispatch confirmation) or at the latest by delivery of the goods.

2.4 Depending on the image size, image file, number of pixels, the end product can vary from the example photo for the respective product that is ordered. This is normal and depends on the quality of the image sent by customers.

3. PRICES

The prices stated on the product page are non-binding and without guarantee and are given in Swiss francs (CHF).

4. SHIPPING COSTS

The delivery is made by insured free shipping. If something is lost, you will have no cost. A new product will be sent to you.

5. TERMS OF DELIVERY

5.1 Deliveries are made all over the world. In order for an order to be placed, the customer must provide at least first name, surname, address, postal code, city and email address.

5.2 Herz-Gift.ch is not liable for delivery delays that are not our fault, e.g. due to force majeure or Covid lockdowns in our production countries and they do not entitle the customer to withdraw from the purchase contract or to claim damages.

5.3 If not all ordered products are in stock, Herz-Gift.ch is entitled to make partial deliveries.

5.4 If the delivery of the goods fails through the fault of the customer despite three delivery attempts, Herz-Gift.ch from the contract step back. Any payments made (excluding payments for shipping costs) will be refunded immediately.

5.5 Herz-Gift.ch may cancel an order that has been placed.

5.6 You agree that Herz-Gift.ch Your data, i.e. address, details and, if necessary (for certain customizable products), pictures to our production partner and shipping there.

5.7. Any customs fees are to be borne by the customer.

6. CUSTOMS FEES

Please note that Swiss customs (or Swiss Post on their behalf) will charge the import sales tax applicable in Switzerland at a rate of 7.7% on the net invoice amount for orders with a goods value of approx. CHF 62.50 can bill. In addition, once the exemption limit has been exceeded, Swiss Post charges a small fee for delivery, which, like any customs duties incurred, must be borne by the recipient. (Since certain products are shipped directly from Turkey or Asia from our partner's warehouse)

7.DELIVERY TIMES

Due to Covid 19, delivery times may be longer than usual, around 15-45 days from the order date.

8. TERMS OF PAYMENT

Herz-Gift.ch offers payment by credit card with the payment provider Stripe, advance payment and on account with the option to pay in installments.

Purchase on account with partial payment option (POWERPAY)

MF Group / POWERPAY, as an external payment service provider, offers the payment method "purchase on account". With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified time frame, you will receive a monthly invoice with an overview of your order in the following month.

When the purchase contract is concluded, POWERPAY takes over the invoice claim and handles the corresponding payment modalities.

When purchasing on account, you also accept the GTC of POWERPAY in addition to our terms and conditions. (powerpay.ch/de/agb).

9. RESERVATION OF TITLE

The goods remain the property of the supplier until full payment has been made and they have been dispatched.

10. RIGHT OF WITHDRAWAL

If the delivered goods are defective or if the delivery is delayed by more than 50 days without the customer having been informed of this beforehand, the customer has the right to withdraw from the contract or, in the case of defective goods, to a replacement . The goods are to be returned to Herz-Gift.ch , the customer bears the costs for the return, unless otherwise agreed by Herz- Gift.ch has been confirmed in writing. There is no right of withdrawal in the event of force majeure. The 30-day money-back guarantee can only be given if the product is in the original, unopened packaging.

11. LIABILITY

All products sold by Herz-Gift.ch are subject to the strictest controls by the respective manufacturer. For this reason, only the respective manufacturer is liable for the quality of his products. The customer acknowledges that Herz-Gift.ch does not carry out an incoming goods inspection of the products delivered by suppliers. Herz-Gift.ch also accepts no responsibility for allergies and the like. A complaint about the delivery for any reason does not release the customer from paying the invoice within the agreed payment period.

12. PRIVACY

The customer agrees that his personal data will be stored and processed electronically within the framework of the business relationship. It is pointed out that data determined in accordance with this provision are collected and processed exclusively for the purpose of providing the service, in particular for the purpose of order processing and accounting. 13. GOVERNING LAW

Swiss law is exclusively applicable to the contracts.
Exclusive place of jurisdiction is Frauenfeld TG.

14. FINAL PROVISIONS

Should a provision of these general terms and conditions be ineffective, the rest of the contract remains effective. The relevant statutory provisions shall apply in place of the ineffective provision.
